In the past I've seen various Yahoo and eBay accounts that sell what suspiciously looks to be discarded items so I wouldn't be surprised if they did that. It would be pretty weak if they discarded your item on exactly the 46th day. Surely it would be reasonable to expect a grace period of some sort.
I've personally never attempted to get compensation for damaged packages, no, since I never had that happen to me fortunately (knock on wood). Just some lost parcels that can be counted with 2 hands, and half of them lost this year. Not bad for 14 years of importing too.
