When did MJ as an original composer for Sonic 3 cease to be anything but wild speculation?

On that note:

-Howard Drossin definitely did the main theme of Sonic & Knuckles (and all the variations based off of it) and Knuckles' theme for that game (Through Sega Tunes • Virtual Sonic).
-Masaru Setsumaru definitely did Data Select Screen (Through Sonic Jam).

Furthering this, Gametrailers and Sonic REtro together have all but confirmed it. There is an inside source from SEGA.

I've been told by members of both parties that they worked with MJ (even Setsumaru saying how it was an honor, although I doubt he worked with him face to face since MJ was based in LA at the time.)

Of course, neither side will publicly say anything about it, since there is so much legal mess surrounding the whole situation. (unpaid royalties and the demos MJ recorded not being in the possession of MJ's estate, it seems)
