So.. even Loudr can't do shit vs Nintendo ?
I am still wondering if this is really (and legally) working.

I wonder why the targeting on this particular album.

Has Pokemon soundtracks been released in US? Or then Pokemon Company treats their licenses better and do not block them like Nintendo did.

Hey, I know this thread is 6 months old, but I thought I'd explain what happened and why.

Basically, a publisher is legally obliged to grant the mechanical license needed to legally cover a song IF that song has been released in the United States. If it hasn't, like in the case of Wind Waker, then it's up to the publisher whether they want to grant the license or not.

Obviously, Nintendo did not want to grant me and Loudr a license to cover 8 of the 14 tracks on the Wind Waker album. I'm guessing the other 6 tracks had appeared on compilations or Smash Bros OSTs or something, so they had no option but to give me them.

It's why OOT has many cover albums, whereas Twilight Princess and others do not (see: Twilight Symphony!).

Of course it's not up to me, but I struggle to see what Nintendo has to lose by granting the licenses – it'll get paid the royalties and sales of fan-made albums may help them decide on a Western release of the OST. But I believe that by not doing so, they are 'protecting their assets'.

I knew this before I started, but I saw a few other Wind Waker tribute albums and figured it would be okay. Guess it serves me right for going about it the proper way.
