Which would be the main point of contention, as the TV series soundtrack does have a release of its own.

The length of tracks is a bad argument. These are suites with several BGM, the duration of which each BGM is shorter.
You can translate the liner notes of the Eternal Edition with Google Lens or the OCR from Discord, but it's well written that there are 2 albums of BGM collections for the TV series "Space Pirate Captain Harlock" that have been released: CQ-7005 and CX-7051. The only difference is that the first album is recorded in suite format. And these BGM are performed by the Columbia Orchestra in these 2 albums.
And I have another argument: if there were only BGM from the CX-7051 album, that would make very, very few BGM for the entire series.

Also you can find some suites in many albums of Seiji Yokoyama, it's still the original soundtrack used in the show.
